Can I withhold rent to fix problems with the house?
I moved into my house 3 months ago and it's been nothing but a farce. I am still stuck in a 6 month AST.
The radiator in the lounge exploded the first time I turned it on, spilling boiling water all over the carpet. The pipes from the bath/shower and sink all run down the garden and behind the extension because there's not enough pipe. The garden is a huge mess when we were told there would be topsoil delivered the week after we moved in. There is a right of way around the back which no-one can use. As well as a few minor issues. Everytime I have a shower I have a bubble stream in my "garden" and I can't even put the heating on.
The landlord knew about these problems when we moved in and has been full of empty promises since. I want to know if anyone knows my rights regarding the situation. Can I withhold the rent and send him the receipts with any change? I can't imagine it will cost the full months rent.

i live in a shared student house and our main bathrooms shower/bath has been broken for about 6 months now and nothing has been done about it, although we call them all the time the fob us off with excuses and say stuff like the plumber is getting the part etc. We are lucky there are 2 other bathrooms in the house with working showers but these are en-suite and its a pain in the mornings. Unfortunately, you can not withold rent. This could result in you being evicted under section 8 of the 1988 Housing Act.
Your landlord has an obligation to repair the bath under section 11 of the 1985 Landlord & Tenant Act.
If there are more than 4 let rooms, it should be licensed as a 'House in Multiple Occupation' by the council. Some councils requre smaller properties to be licensed too. The HMO officer at your local council may be able to make the landlord repair the bath etc.
You may also be able to get help from the Environmental Health Officer at the council.

me and my partner moved in to a flat last weds, we've found problem after problem and when the estate agents plumber came to take a look he said we shouldn't have been permitted to move in with the house in this state. the main bits are the plumbing could burst at any time, boiler unit is hanging off the wall and incredibly old, and theres mold everywhere etc etc.
me and my partner aren't happy with the estate agent saying she has no idea when anything could even start getting fixed on the house, let alone how long it will take. the bedroom is freezing cold and my daughter has had to stay with my mother for a while as she's been very very ill, im in the early stages of pregnancy and my partner is at his wits end. we don't know what to do next, we can't stay in that house while the repairs are going on because ALL the piping needs ripping out, new boiler, new rads the lot. my estate agent admitted they only check for holes in walls and missing windows basically (if anyone had looked a bit better they'd have seen huge puddles in the kitchen). as we can't stay during the repairs does anyone know if the estate agent has to provide a place for us to stay or have any other advice for us? please?! staying with my mother tonight as its too bad in the house.

This gives contact numbers as well. Shelter is a great organisation in these situations, particularly since you can't be without accommodation.
You shouldn't be paying any rent for a property that is not habitable, so cancel any standing orders for rent you have set up, Advise the estate agent in writing (e-mail will do) that the property is uninhabitable, and fails to meet minimum safety standards.
Tell the estate agent that they better arrange for alternative accommodation otherwise you will be forced to report them and their client for failing to comply with their responsibilities.
If estate agent can get you into temporary accommodation, you'll still have to pay but is this is more expensive, estate agent should be asked to pay difference - this should motivate them to get the repairs done.
The Council may be able to help if you are classed as homeless.

I live in a flat on the top (2nd) floor flat in my block. The water pressure is very low much of the time but sometimes ok. Three times recently, however, I've run out of cold water altogether. This has happened in the morning when the second of two people in the house has been showering. If you are suffering a loss of water pressure you will notice it specifically on your kitchen cold water supply as his is fed directly from the mains. Depending on your water supply company you may suffer a loss on other taps. If all of your system is mains fed then you will normally have pretty good pressure on all taps, but only some companies will allow supply of mains pressure to all taps. Your most likely reason for loss of supply is, that, there is a tank in or on the roof and this is not getting enough water for the building. Consequently, if everyone tries to draw water at the same time someone runs out of water until the tank can refill again. The only solution I can see here is for a bigger tank.Problems with our rented house?
My boyfriend and I moved into a rented house in January. From the start we had problems with it. They kept putting off the moving in date because things weren't finished etc and then when we did finally move in they were still fixing plumbing, floorboards etc. This was all sorted eventually and although it was annoying due to the fact they'd promised us a moving date and we'd moved 200miles so had to stay in a hotel until it was ready, we were just relieved for it all to be sorted in the end.

About 2-3 months ago loads of the fencing was blown down in the garden. Not just a few planks, whole panels that are lying all over the place. We are a middle terrace so now have no privacy in our garden from either side. We have been asking and asking for them to sort it out but they still haven't done anything. We didn't pay the rent this month on time and told them we'd pay it once they'd got it sorted. Continued below!
They promised that it would be sorted within the week as long as we paid the rent so we did and surprise, surprise it hasn't been sorted! Are we being unreasonable expecting them to fix things like that? It's just we really want to be able to use the garden now that the summer's coming! That's the first point, if its not its up to the neighbour to repair it.
Withholding your rent is not a good way forward as you leave yourself open to eviction for non payment.

please help i am renting a property from an estate agency who promised to fix a few repairs which need doing:
The letter box is broken
The door bell don't work
The tiles in both bathroom are all cracked and dangerous
The light in my little girl bedroom doesn't work all the wires are hanging out the ceiling
And the whole house is so dirty
There are other problems but the list goes on i had the manager of the estate agents come round and i paid my months rent to him and he promised the work would get done but 4 weeks on and no work is done i haven't paid the last months rent as i dont think i should and they keep phoning me cause i am in rent earears what can i do as these estate agents only seem to want to get there money and not worring what state the house is in thank you all the advise i can get would be appreciated.
You have done yourself no favours by not paying your rent. You pay rent to live in a property so by doing this you are stating that you think you are entitled to stay there for nothing and if thats the case then move out and find somethething more to your standards. Your Landlord has a duty to maintain the property to a safe condition but you should check your agreement as most assured shorthold agreements show a clause that states you as a tenant will have the role of any other householder and smaller repairs and maintenance (the ones i use state £25.00) are down to yourself if below that threshold. In real terms you are asking for work to be done but are in rent arrears. Your local Environmental Health office can help you by visiting your property and then assessing any risk to yourself due to the repairs. They will then contact the Landlord and serve a notice for remedial works to be done in a suitable time scale should they feel it appropriate. Unfortunately you will probably now find that an eviction notice or order for possession is served on you as you are in arrears. I am building a deck and do not have sufficient space to dig down to allow it to be fixed to the house 2 bricks below the damp-proof course. It is a brand new house. Should it be a problem or should I go ahead with it anyway?
'Splash' is the concern, leading to rising damp.
Leave a gap as advised above, but consider adding a lip to the edge of the deck nearest the wall to intercept the splash before it reaches the bricks.
Belt and braces, maybe...but who wants the worry?
