  • How to evict the tenant who is occupying one room in a flat with few others?

    First of all, no paper has been signed at the start. There is one month deposit with the landlord. The reason of eviction is nuisance and lack of cooperation of the tenant. The tenant is stirring the trouble up with others, he is making up the stories, and he is not happy with the flatmates ( because they are males not females!).

    I think the best bet is to discuss the situation with your Landlord.--I am sure that he doesn't want everyone to end up leaving and having an un-rented apartment. He will know the best way to proceed and hopefully help you. This is one of the draw-backs you have to deal with when sharing a place--and you really need to figure out a way to protect yourself by having some sort of written agreement with anyone in the future.
  • How much time and money does it cost to evict a tenant?

    What is the procedure for getting a tenant to leave when s/he refuses to do so even though notice has been served to them? Is it straight forward to evict a tenant when the tenancy agreement has expired. Whilst the eviction order is being given does the tenant still have to pay the rent in that interim period?
    Each state has very specific steps to follow...You can't evict until you get an Eviction Order/Judgment from the Court. You have to get a hearing, then you have to serve notice of the hearing (via process server) and then you get the hearing.

    Then if they don't leave, you have the constable execute the Order, if they don't leave -- the constable calls the police to enforce it.

    You should google your state and landlord/tenant laws to make sure you follow the steps correctly. If you make a procedurial error, the whole clock has to start over again.

    Don't be intimidated though, I evicted my tenant in 20 days start to finish all by myself - I created the Notices on Word and got the Arizona landlord's handbook.

    The key is to start the legal clock ASAP. It cost me about $200 altogether and I requested that amount in addition to the back rent and late fees.

    Under UK property law. What is the procedure to remove a unwanted tenant who has repeatedly been late on his monthly payments and how long will it take for him to be removed.
    It is a legal process and you will need to consult a solicitor.

    You will need a little more than just late payment as it may be taken that they are still 'paying up' even if late.

    Did you use the protected deposit scheme to give you an amount in hand?

    It may be more cost effective to not renew the lease at the renewal point.
  • What can one do to a tenant whos contract finished, got 30 days advance notice but stays?

    The tenant always paid on time for the entire 4 years of his rental agreement, we did not want to continue and renew his contract and so we sent him a correspondence that we need the apartment, assuming now he got upset that he has to leave, the end of the month came up and we heard nothing from him, no keys or even a email.

    We asked some neighbor and she told us the tenant plans to stay in the apartment but does not have a job any more or place to go.
    Try having a bit of sympathy

    Imagine if you were renting and you lost your job then you were asked to leave

    I would be pretty upset as well

    This guy has been paying your mortgage for you

    Try and contact him and offer him some support let him claim Housing Benefit od DSS - your rent still gets paid
  • What is the procedure for returning mail to previous tenant who left no forwarding address?

    I am forever getting mail, mostly from the same source on a daily basis for the previous tenant. I write "not known at this address" and post it, but sure as christ, the next day I have another one. The post office are obviosly not doing their job properly. This guy gets more mail than I do, it has been going on for months. Would it be ok just to bin any future letters, as I am sick of it.
    Forward it to the landlord or his agent and ask them to deal with it.
  • Can tenant demand removal of furniture from a furnished flat?

    We are renting out a flat. It was advertised as furnished, as we have a bed, table, sofa, chairs and shelves in there.

    A tenant wants to move in this Saturday, but wants to bring her own furniture, and asking that we remove our furniture.

    We would only have to move them all into the garage, but are annoyed that we are expected to do so when it was advertised as furnished.

    Does the tenant have any right to expect us to move our furniture?
    No you can tell them they can remove the furniture but must store it at a cost to them and all the furniture must be put back in when they leave in the condition you left it.

    As you advertised it as funished then they have to do the donkey work not you.

  • What rights does a tenant have holding a verbal contract with previous sub-landlord under an expired tenancy?

    The previous sub-landlord's (head tenant's?) contract with the landlord has ended and they are no longer resident. Before officially leaving they moved someone into their room who now say's "You'll have to get a court order to evict me," even though they have just been asked to move rooms by the new sub-landlord who has a new contract with the landlord and no agreement with this tenant.
    If I were you I would contact an attorney. Sounds complicated to me.

    Do you have a written lease? If so, you need to read it carefully to see whether there may be other grounds for evicting him. If your solicitor is cautious, it's probably with good reason. If he is not in current arrears, you can't evict him for non-payment of rent...even if he has been late in the past. You say he owes nearly £10K - is that in missed payments? you are entitled to set any rent he pays against past missed payments..i.e. if he missed January but paid March you can set the March payment against the January rent and say he's late with March...does that make sense? If you do not have a written lease, there are "implied covenants" - he is obliged to keep the place in good repair, for example and you can evict him if he does not do so...sounds like it's a matter of time before he misses another payment, then you can evict him, but it is a long process
  • Does a Tenant have the right to know if a rental agreement will go into periodic tenancy?

    Is the landlord or the landlords agency required by law to tell the tenant that after the minimum fixed rental term it will automatically go into a periodic rental agreement?
    How does the tenant know it will if he was never told and if the agreement has been very badly written? Shouldn't it be good if the agent asked the tenant two months before the end of the minimum fixed period what they intent to do at the end of the minimum period?
    The agreement will continue into a period tenancy if the landlord does not give notice and the tenant wants to stay. If the tenant wants to leave he can simply vacate the premises on the final day of the fixed term, without penalty. Once the periodic tenancy starts the tenant can leave with one month's notice, although this needs to expire on the month "anniversary" of the tenancy, unless the agreement provides otherwise.

    I'm not sure why there should be a "right" to be told this. Any reasonable tenant should be aware of their rights, or should take steps to find out what they are.

    I helped an agent secure a tenant for a studio flat in London, UK for about £150 pw. He has promised me a commission, but since this is my first (unofficial) venture in this area, I don't have any idea how much that should be. Can anybody give me some ideas? How much should I ask for?
    Estate and lettings agents typically charge landlords anywhere from .5 of a month to one month's rent in commission, plus admin fees, unless they are also acting as property manager for the landlord in which case they will take a monthly percentage.

    What they're willing to give you depends utterly on what their actual commission arrangement is. How much 'help' did you actually provide in finding a tenant? If you played a major part, ask for 25% to 50% of what they receive. If you simply knew of somebody looking for a place and told them you knew about a vacant flat, less. Whether the agent thinks you deserve what you ask for is for the two of you to argue over.
