who is responsible for the fence between my garden and my neighbours?
The fence at the end of my garden is in serious need of repair. The fence posts are on my side of the fence, the good side of the fence faces my neighbours garden. Who would be responsible for this fence, me or my neighbour. Of course the cost of a new fence might or could be shared but who does the fence belong to according to boundary laws?
The responsibility for the fence will be written into your house Deeds. That is the only certain place where you'll find the right answer. Your neighbour will have a matching entry in his deeds.

Its a good quality fence, but the plants still find gaps to get through, particularly between the fence panels and the concrete posts. Keeping it trimmed back is problematic, because parts of the fence are in a very hard to reach place. Are there any fence treatments/paints you can get to overcome this problem?

Why don't you have a word with your Neighbour, that's if you are on Speaking terms?
Otherwise if it were me I would Cut them right down to the Roots and throw them over into their Garden,hopefully they will get the Message or even come round to have a Word with you about it.

My house is situated on the top of a hill, I have a small garden - the half nearest the house is a good three feet higher than the bottom half, which is paved and you go down some steps to get to it.
All the fences we have are currently waist height and we would like to not only level the garden but have the normal 6 foot fences as well for privacy.
Here is where it gets complicated, our house is sideways on to our back neighbours, so instead of the bottom of our gardens meeting, our back fence runs parallel to their side fence almost the entire length of their garden.
There is also an alleyway between us.
Because of the hill, the fence is waist height if you were standing in our garden, but 6 foot high if you were standing on the other side in the alleyway, and as a result the back neighbours garden is again lower still.
We would like to do it but find it hard to beleive we would be allowed to put up a fence that would tower over the alley and the neighbours like that.

Have been up and down my road to see if anyone else has made their fences higher, and yes, in some instances people have put up enormous fences or walls to keep their garden private.
But we are unable to find an example of one that overshadows someones house or garden, it's only when peoples gardens back onto the road that they have done this.
We had a man round to quote on a fence and he didn't mention any possible legal problems we could encounter, but I suppose he wasn't going to - he just wanted the job.

We were looking into putting up a privacy fence, but after receiving a free estimate this was a little more than we would like to spend. I think the estimate was around $7,000. Your property deeds tell you which bondaries of the property you are responsible for although it is difficult to force the neighbour to repair the fence if it is their responsibility and they don't really want to.

Fence panels divide my driveway from my neighbour. As soon as wind picks up the fence breaks and panels are on my driveway. He will do nothing for a few weeks and will then do a botch up job until the next collapse.

This is probably a rather silly question, but all the advice I've found so far says to make the fence at least 1.2 metres high and to sink it 30cm into the ground at an angle. We have just put chicken wire around our allotment, about a month ago. We bought one metre high wire, with 2.5cm holes and burried it 1 foot under ground, turning it out wards so that the rabbits can't burrow under it. So far so good, the rabbits haven't got it. We manage to step over it so there is no need for a gate. I have bought 2 tins of fence paint and have now purchased a fence paint spray gun. The gun says it is suitable for painting fences with water or oil based paint, but I cannot see this anywhere on the tub. I know that some paint says 'sprayable' on the tub, but this one doesnt, but is quite watery? Are there any tests that I can do to determine if it is oil or water based?

Oil-based paint can be identified in the following ways.
Read the label: The product is solvent or oil-based if the instructions are to clean with mineral spirits or turpentine. If cleanup instructions say you can clean your brush with soap and water, it is typically latex or water-based paint. If you can’t read the label, assume it is oil-based for disposal purposes.
Water test: If the paint is water-based, it will dissolve in water easily. Place a small amount of paint in a small clear container with some water. Latex paint will mix with the water while oil-based paint will separate and form layers similar to the layers formed when oil and vinegar are mixed.

Ah it sounds like he has taken YOUR fence down so as far as I know you can not take someones fence down and do as you like.
I think the only time you can do that was if it was not safe, say for example high winds and it was going to crash in to the windows or something like that then you would have to explain to the neighbor.
I think that may be known as theft if it is your fence tell him to put it back failing that he will be blocking your light out and I think the council can get envolved there.
